FERNANDO LUGO Y EFRAIN ALEGRE ENCUBRIENDO LOS DESPOJOS EN YACYRETA
Un profundo conocedor del comportamiento humano y discípulo de Sigmund Freud, Alfred Adler, escribió que es más fácil luchar por unos principios que vivir de acuerdo con ellos. La frase podría venir como anillo al dedo al ministro de privatizaciones de Fernando Lugo, Efrain Alegre, quien denunciaba con insistencia violaciones del tratado de Yacyreta que eran perpetradas por los gobiernos anteriores, y apenas tuvo la posibilidad no dudó en incurrir en los mismos despropósitos.
Dice la historia que el 23 de enero de 1958 se firmó un convenio entre el Paraguay y la Argentina donde se resolvía realizar estudios técnicos técnicos tendientes a obtener energía eléctrica del Río Paraná a la altura de las islas de Yacyretá y de Apipé y a mejorar las condiciones de navegabilidad de dicho río. El emprendimiento condujo a firmar el 3 de diciembre de 1973 un tratado que otorgó vida jurídica a la Entidad binacional Yacyretá, aprobado y ratificado por la ley número 433.
El tratado de Yacyreta había sido suscripto con los anexos A, correspondientes a la entidad mencionada, el anexo B correspondiente a la descripción general de las instalaciones destinadas a la producción de energía eléctrica y al mejoramiento de las condiciones de navegabilidad, y el anexo C, correspondiente a las bases financieras y de prestación de los servicios de Electricidad de Yacyretá y las cinco (5) Notas reversales intercambiadas por los ministerios de relaciones del Paraguay y de la Argentina, todas en la misma fecha.
El tratado también implicaba que el anexo C del Tratado no podía ser cambiado en ninguna de sus formas y cláusulas, y tampoco tenían sustento legal ningún proyecto de cambio que implique un adelanto de las revisiones.
A pesar de ello, se firmó la Nota Reversal del 9 de enero de 1992 referida a la tarifa y financiamiento del Proyecto Yacyretá que fijara, arbitrariamente y contra estipulaciones del Tratado, el costo de suministro de electricidad a ser pagado por la entidad administradora de los servicios eléctricos a cada país en 0.030 US$/Kwh desde el inicio de la generación, independientemente de la cota de agua en la altura de la represa, y hasta el año 2048, considerado este como último año de vida útil de la represa.
El Congreso Nacional del Paraguay rechazó el referido instrumento diplomático por Resolución Nº 492 de la Honorable Cámara de Senadores de fecha 15 de junio de 1995, fundada en el hecho de que la vigencia de la misma puede ser considerada como un subsidio al Estado argentino en detrimento de los intereses paraguayos.
De esta manera, quedó ratificada la nulidad de la nota, carente de efectos jurídicos.
VIOLANDO TRATADOS
A pesar de ello, el obispo presidente de la República Fernando Lugo firmó el decreto Nº 3.564 en el que se aceptaba el pago de 140 millones de dólares por la energía de Yacyretá cedida por Paraguay a la Argentina, violando el Anexo C del Tratado.
El mencionado decreto del Poder Ejecutivo ratifica el Acta de Acuerdo fue suscripto por el ministro argentino de Planificación, Julio De Vido, y el ministro paraguayo de Obras Públicas, Efraín Alegre, el pasado 6 de enero del año 2009 en Buenos Aires.
De esta manera el ministro Alegre, actualmente embarcado en el remate de rutas, aeropuertos y hasta espacio aéreo del Paraguay, se vio involucrado en el mismo tipo de chanchullos que anteriormente denunciara con persistente insistencia.
La transgresión hizo que se presentaran denuncias contra Lugo y Alegre por basarse en un acuerdo nulo para recibir dinero argentino.
La propia Contraloría General de la República (CGR), en un examen especial realizado en 2007, concluyó al respecto que el Paraguay “es el más perjudicado con lo establecido en la Nota Reversal del 92 sobre todo por haber incluido las compensaciones por Cesión de Energía y por Territorio Inundado entre los beneficios a ser diferidos para cooperar con el financiamiento del proyecto de Yacyretá”.
La ejecución actual del denominado Plan de Terminación de la binacional, conocido como PTY es ilegal puesto que implica la aplicación de los términos del Preacuerdo que no fue aprobado por el Congreso.
CONCUBINATO FASCITOIDE E IMPUNIDAD
El concubinato entre el cura Fernando Lugo y el general golpista Lino Oviedo ha empezado a dar frutos, y uno de ellos es la impunidad para quienes defraudaron al Paraguay desde las altas esferas de la entidad binacional Yacyreta.
En ese constexto, el sacerdote católico Pedro Robadín denunció esta semana ante el Jurado de Enjuiciamiento de Magistrados (JEM) a los fiscales Fabián Centurión y Silvia Cabrera, por mal desempeño en sus funciones.
Las mencionadas autoridades no cumplieron con su deber de investigar seriamente al presidente Fernando Lugo y al ministro Efrain Alegre, quienes violaron tratados de la EBY, ocasionando un perjuicio a la Binacional.
La denuncia sostiene que los fiscales Centurión y Cabrera no impulsan debidamente la investigación en la causa, como era de esperarse en un caso que atañe a poderosos.
Al parecer la justicia hoy en las ávidas manos de los esbirros del luguismo, aplica el refrán de Campoamor cuando decía que en este mundo traidor, no hay verdad ni mentira: todo es según el cristal con que se mira. LAW
